Return & Refund Policy
Effective date: September 15, 2026
This policy explains how Simmons Motorsports Inc. ("Simmons," "we," or "us") handles order cancellations, voluntary returns, and refunds. Please review it before purchasing. It forms part of our Terms & Conditions.
This version applies only to orders placed on or after its effective date where properly disclosed and applicable. Earlier orders retain the policy applicable when those orders were placed. A later policy change does not retroactively increase charges for an earlier order.
1. Policy at a glance
-
Customer-caused cancellation requested before shipment: A 5% cancellation fee is deducted from the amount paid for the canceled order, subject to the exceptions below.
-
Voluntary return request after delivery: Contact us within 5 calendar days after delivery. Merchandise must meet the eligibility requirements below.
-
Approved voluntary complete-bike return after shipment: 10% restocking on the discounted bike price, excluding tax and shipping; original checkout shipping is nonrefundable and return shipping is the customer's responsibility. No additional 5% cancellation fee.
-
Opened, assembled, installed, or used merchandise: Not eligible for ordinary change-of-mind returns, unless a different product-specific rule was disclosed before purchase.
-
Defects, incorrect items, damage, recalls, or warranty concerns: Reviewed separately. Ordinary change-of-mind restrictions do not eliminate protected remedies.
The detailed requirements and exceptions below apply. Mandatory law and binding payment-provider requirements control if they require a different result. This policy does not waive protected consumer, warranty, recall, or payment-dispute rights.
2. Canceling an order before shipment
Email simmonsmotorsportsinc@gmail.com as soon as possible with your order number, name, and the items you want to cancel. You may also call (949) 409-1066 for assistance. Keep your request and our response for your records.
If we receive your cancellation request before the affected goods have been handed to the carrier for shipment, we will cancel the affected order or items. For a voluntary customer-caused cancellation, a cancellation fee of 5% of the amount actually paid for the canceled order, after discounts, will be deducted from the refund. For a full-order cancellation, that calculation includes the shipping and tax amounts paid with the order. The remaining refundable balance is returned through the refund process below. No fee is calculated on money that was never paid.
Examples of customer-caused cancellations include changing your mind, ordering the wrong item, placing an unintended duplicate order, or no longer wanting the purchase for personal or financial reasons. Discovering that a product does not meet your intended use may fall into this category if the relevant limitation was accurately disclosed before purchase; this does not excuse inaccurate listings, missing required disclosures, or other seller responsibility.
Partial-order cancellations: The 5% calculation is limited to the amount paid attributable to the canceled items and their attributable paid shipping and tax, not the items you keep. Applicable tax adjustments and refunds must be handled as required by law.
The same cancellation rule applies across payment methods, subject to law and binding provider requirements. We deduct the permitted amount from the refund rather than imposing an additional payment-method-specific charge. No pre-shipment restocking fee is added.
When no cancellation fee applies
We do not charge the 5% cancellation fee when cancellation is caused by Simmons—for example, our inability to fulfill the order, an inventory or listing error, a pricing mistake, or a merchant-caused delay for which a cancellation remedy applies. Correcting a duplicate or erroneous charge by Simmons is not treated as a customer-caused duplicate order. We also do not impose a fee where applicable law or a binding payment-provider requirement prohibits it.
In these cases, we refund the amounts required by the applicable remedy, including shipping and tax where required. Legally required cancellation rights are not dependent on discretionary approval.
3. Orders that have already shipped
After the affected goods have been handed to the carrier, a change-of-mind request is handled as a return rather than a pre-shipment cancellation. Contact us for instructions before refusing delivery, arranging redirection, or sending a shipment back. Requests to intercept a shipment depend on the carrier and are not guaranteed.
For an approved complete-bike return, the 10% restocking and shipping rules in Section 6 apply once. We do not add the 5% pre-shipment cancellation fee to that return.
Separate, reasonable, previously disclosed costs caused by an incorrect address, missed appointment, unjustified refusal, or inaccessible delivery location are handled under Section 10 of the Terms & Conditions, subject to its exceptions. We do not charge twice for the same cost.
4. Voluntary return eligibility — five-day request period
For otherwise eligible merchandise, request a voluntary return within 5 calendar days after delivery. This is the deadline to request a return; it does not require the goods to arrive back within five days. Written instructions will identify the approved destination and shipping arrangements.
For an ordinary change-of-mind return, merchandise must remain:
-
Unopened, unused, unassembled, and uninstalled.
-
Complete, with its original packaging and all included components, labels, manuals, keys, charger, and accessories, as applicable.
-
Unmodified, undamaged by the customer, free of contamination, and in resalable condition.
A different product-specific rule applies only if it was clearly disclosed before purchase. Opening a package, assembling the product, installing parts, riding, or otherwise using it ordinarily removes eligibility for a change-of-mind return. It does not, by itself, eliminate a defect, incorrect-item, warranty, recall, or other protected claim.
5. Return authorization and exclusions
Contact us for written return instructions before shipping anything back. Include your order number, contact information, the affected item or items, reason for the request, and reasonably available photographs of the goods, packaging, and seals. We may request an authorization number and relevant additional information.
Use the return destination and packing/shipping instructions we provide. Our contact address is not automatic authorization to return an item there. An unauthorized shipment does not itself create a right to a refund; it will be handled consistently with this policy and applicable law.
Standalone batteries: Spare or replacement batteries sold separately are not eligible for change-of-mind returns once delivered, even if unopened. A battery supplied with a complete bike remains subject to the complete-bike policy when returned with that bike.
Other items may be excluded from voluntary returns when disclosed before purchase, including loose cells, installed parts, used protective equipment, special-order or final-sale items, and goods that cannot safely or lawfully be transported. These exclusions do not eliminate protected remedies.
6. Restocking, shipping, and other permitted deductions
For approved change-of-mind returns of complete bikes, including e-bikes and e-motos, the restocking deduction is 10% of the amount actually paid for the returned bike after discounts, excluding tax and shipping.
The original shipping charge paid at checkout is nonrefundable for these voluntary returns, and the customer pays return shipping. This does not create an additional charge for hypothetical shipping or an undisclosed free-shipping subsidy.
The 10% complete-bike fee does not establish a percentage restocking fee for other merchandise. Where separately disclosed and lawful, voluntary-return deductions may reflect actual missing components, diminished value, repacking, or freight costs. Any additional deduction must represent a separate loss or cost, not one already covered by the restocking fee or another deduction.
The change-of-mind restocking fee is not charged for defective or incorrect items, shipping damage not caused by the customer, or legally required remedies. We bear shipping and other costs when our error, the applicable remedy, or law requires it. Tax adjustments are made as required by law.
7. Damaged, defective, incorrect, or incomplete goods
Contact us promptly upon discovering a problem. Reporting visible delivery issues within 48 hours of delivery is preferred, but this is not an automatic cutoff for claims or protected rights. Report concealed problems promptly when discovered.
When safe, preserve the packaging and provide relevant photographs, the shipping label, order number, and available product/serial details. An unboxing video is helpful but is not mandatory or the only acceptable evidence. Missing evidence alone does not establish customer fault.
Stop assembly or use if you discover damage, missing or incorrect parts, or a safety concern, and contact us for instructions. Opening packaging to inspect the goods does not by itself bar a protected claim. Never charge or operate equipment suspected to be unsafe.
Claims are reviewed under the applicable manufacturer's warranty, the Terms & Conditions, and law. Remedies depend on the claim and may include assessment, parts, repair, replacement, or refund where appropriate. This policy does not create a new Simmons warranty or replace the manufacturer's warranty. Sections 10, 19, and 22 of the Terms explain delivery claims, warranty coverage, and reasonable claim verification.
8. Refund method and timing
-
Original payment method: Refunds are normally processed to the original method used for the purchase, subject to applicable law and provider requirements. We do not substitute store credit where the applicable rules require a monetary refund.
-
Returned bikes: We complete inspection and issue any approved refund within 10 business days after receiving the returned bike, unless an earlier deadline applies. We may complete it sooner.
-
Canceled orders and non-bike returns: Refunds are issued promptly and within applicable legal deadlines. The returned-bike inspection waiting period does not apply to cancellations before shipment. For returns, receipt and evaluation normally precede the refund unless an earlier refund is required.
-
Bank or provider posting: After issuance, allow an estimated additional 5–10 business days for posting. Actual timing varies; this estimate is not a guaranteed deadline.
For a financed purchase, the refund is processed through the appropriate original payment channel. The financing provider handles any resulting loan adjustment under its agreement; Simmons does not promise that marking an order canceled by itself cancels the customer's financing obligation.
9. Safe return shipping
Retain and use suitable protective packaging and follow our written directions and the carrier's requirements. Never send a damaged, swollen, leaking, recalled, or otherwise unsafe battery through ordinary return shipping. Contact us first for a safe, lawful process. Do not endanger anyone to package, transport, photograph, or preserve unsafe equipment.
